1. Assumption of Risk

Pickleball is a physical activity that carries inherent risks, including but not limited to falls, collisions, and other injuries. This also includes risks common to any recreational sport facility — such as being struck by a paddle or ball, strains, sprains, fractures, and other musculoskeletal injuries, cardiovascular exertion, and aggravation of pre-existing medical conditions. By playing, you understand these risks and voluntarily choose to participate despite them.

2. Health & Fitness Self-Certification

By joining, you confirm that you are physically fit to participate in pickleball and related activities, and that you are not aware of any medical condition that would make your participation unsafe. Dink Deck PH will not be held accountable for any health-related incidents that may arise during your participation. If you have any doubts about your fitness to play, consult a physician before participating and inform Dink Deck PH staff of any relevant condition.

3. Release of Liability

To the fullest extent permitted by Philippine law, Dink Deck PH will not be held responsible or liable for any injuries, accidents, or damages sustained before, during, or after your session at the facility. You release, waive, and discharge Dink Deck PH, its owner, staff, coaches, and agents from any and all claims, demands, or causes of action arising from ordinary negligence in connection with your participation in activities at the facility. This release does not apply to, and nothing here waives, any liability arising from gross negligence, willful misconduct, or fraud, which Philippine law does not allow to be waived in advance.

4. Indemnification

You agree to indemnify and hold Dink Deck PH harmless from any claims, damages, or expenses (including reasonable legal fees) arising out of your own act or omission while at the facility, except where such claims arise from Dink Deck PH's gross negligence or willful misconduct.

5. Medical Treatment Consent

In the event of an injury or medical emergency during your visit, you authorize Dink Deck PH staff to contact emergency services and/or your emergency contact, and you consent to reasonable first-aid or emergency medical treatment being administered or arranged on your behalf if you are unable to give consent at the time.

6. Facility Rules

You agree to follow all posted facility rules, court schedules, and staff instructions. Proper attire and footwear (non-marking court shoes) are required, and protective gear is recommended. Dink Deck PH may deny or revoke access for conduct that endangers other players or violates facility rules.

7. Participants Under 18

A player under 18 years old may only participate with the consent of a parent or legal guardian, who must review and accept this waiver on the minor's behalf before the minor is permitted to play. Under Philippine law, a minor's own acceptance of a waiver does not independently bind them — a parent or legal guardian's consent is required. Please have a parent/guardian complete this step, or check in with front desk staff.

8. Photo & Video

Dink Deck PH occasionally takes photos or videos at the facility for promotional use (e.g., social media, website). You can opt out at any time by informing staff — this doesn't affect your ability to book or play.

9. Governing Law

This agreement is governed by the laws of the Republic of the Philippines. If any provision is found unenforceable, the remaining provisions remain in full force and effect.

10. Acknowledgment

By checking "I agree" (or the box on the payment screen), you confirm you have read this waiver in full, understand its contents, and voluntarily agree to its terms — and that you are at least 18, or are the parent/legal guardian of a participant under 18 and are accepting these terms on their behalf.
